General Conditions of Use of the www.komnmok.com website
ARTICLE 1: Definitions
The purpose of this clause is to define the essential terms of the contract. The terms listed below shall have the following definition between the parties:
Member: refers to any User over eighteen (18) years old, whether an individual or a professional, who has joined the KomNmoK portal, including the KomNmoK values charter, and has created an Account to which they connect using a strictly personal and confidential username and password.
Personal Account/profile: refers to data relating to the Member and the User and their use of the Site, stored in their Personal Space.
TOS: refers to these general conditions of use governing the respective obligations of Visitors and KomNmoK in the context of access to and use of the Site.
Specific Content: refers to content accessible only to Members and subject to specific general conditions.
Third-party Content: refers to third-party content accessible on the Site for which KomNmoK has no ownership rights.
User Content/ads: refers to data transmitted and content published by the User on the Site.
Personal Space: refers to the site interface through which the Member accesses their Account and specific content.
Username and password: refers to all information necessary to identify a Member or a User on the website. The username and password allow the Member and the User to access specific content via their personal space. The username and password are strictly personal and confidential.
Services: refers to the services constituting all content accessible on the website.
Site: refers to the website accessible at https://www.komnmok.com.
User: refers to any person over eighteen (18) years old, using the Site, including any Service accessible to the User, without having joined KomNmoK and having created an Account to which they connect using a strictly personal and confidential username and password.
Visitor: refers to any person accessing and/or using the Site.
ARTICLE 2: Purpose
These general conditions of use define the conditions of access and use of the website https://www.komnmok.com by Visitors.
These TOS are binding between the Visitor and KomNmoK. The Visitor must therefore read them carefully before accepting them. In the context of accessing and using the Site, the Visitor must comply with all provisions of these TOS.
These TOS apply to the Visitor whether they consult the content and Services made available on the Site or provide content that will be published on the Site.
ARTICLE 3: Presentation of the Site
KomNmoK operates the Site accessible at https://www.komnmok.com, which features international real estate listings, architecture and design object listings, leisure listings, and news articles on the blog. The Site also allows Users and/or Members to access various types of resources and Services to facilitate their process of purchasing properties abroad.
ARTICLE 4: Acceptance and enforceability of the TOS
The use of the Site by the Visitor signifies their acceptance of these TOS. The TOS are deemed read, applicable, and enforceable against the Visitor on the date of their first use of the Site. The Visitor may at any time cease to use the Site but remains responsible for any prior use.
ARTICLE 5: Modification of the TOS
KomNmoK may unilaterally and at any time modify these TOS, in particular to adapt them to legislative or regulatory changes or to adapt them in case of changes and evolutions of the Services and content offered on the Site.
The Visitor must regularly consult the TOS to be informed of modifications. The modified version of the TOS will be accessible at the following address: https://www.komnmok.com/fr/mentions-legales.
If the Visitor continues to use the content and Services of the Site after the publication date of the new TOS, they are deemed to have read and accepted them.
ARTICLE 6: Contractual Documents
The contractual documents binding the Visitor are:

where applicable, the specific conditions for certain specific content on the Site.
In case of contradiction between documents of different nature or rank, the provisions contained in the higher-ranking document shall prevail for obligations in conflict of interpretation. In case of contradiction between the terms of documents of the same order, the most recent documents shall prevail over the others.
ARTICLE 7: Access to the Site
The Site is freely and gratuitously accessible anywhere to any Visitor with Internet access. All costs for accessing the Site (computer equipment, software, Internet connection, etc.) are borne by the Visitor.
The Site is accessible 24 hours a day, 7 days a week. However, access to all or part of the Services and content of the Site may at any time, without prior notice or compensation, be subject to interruption, suspension, or modification, in particular to perform updates, maintenance operations, or modifications of any type to evolve the Services and content of the Site.
The Visitor undertakes not to claim any compensation following the interruption, suspension, or modification of the Site. The Visitor has the possibility to contact the Site by e-mail at
KomNmoK implements all means at its disposal to ensure quality access to the Site and its Services. As the obligation is one of means, KomNmoK's responsibility will not be engaged if this result is not achieved.
ARTICLE 8: Personal Account and Membership
8.1 Creation of a User personal account with username and password
Access to certain content is conditional upon the User's registration on the Site. Upon registration, the User undertakes to create a personal Account accessible by Username and Password created based on accurate, complete, and up-to-date information about their person and civil status. The User must also regularly update their data to maintain its accuracy.
The User must also imperatively provide a valid e-mail address, to which KomNmoK will send confirmation of their adherence to the Services.
An e-mail address cannot be used multiple times to register for the Services. Any electronic communication made by the Site and its partners is therefore deemed to have been received and read by the User. The latter therefore undertakes to regularly consult the messages received at this e-mail address.
The Password can be changed online by the User in their Personal Space. The Password is personal and confidential; the User undertakes to preserve its security and confidentiality and not to communicate it to third parties.
The User is solely responsible for any activity carried out from their personal Account. If the User becomes aware of the fraudulent use of their Personal Account by a third party, they must alert KomNmoK as soon as possible by writing to
KomNmoK cannot be held responsible for losses caused by the fraudulent use of a User's personal Account.
KomNmoK reserves the right, in any event, to refuse the opening of a personal Account if the User fails to comply with the provisions of these TOS.
8.2 Creation of a Member personal account with username and password
Access to certain content is conditional upon the User's membership in KomNmoK. Upon joining, the Member undertakes to create a personal Account accessible by Username and Password created based on accurate, complete, and up-to-date information about their person and civil status. The Member must also regularly update their data to maintain its accuracy.
The Member must also imperatively provide a valid e-mail address, to which KomNmoK will send confirmation of their adherence to the Services.
Only one registration for the Site's Services is permitted per natural person.

8.3 Closing of a Personal Account

KomNmoK also reserves the right to temporarily or permanently close the User's and/or Member's access to their personal Account if they do not comply with these TOS or if they are compelled to do so by law.
The User and the Member will be informed, as soon as possible, of the reasons justifying the temporary or permanent closure of their Personal Account by e-mail to the e-mail address they provided at the time of their membership.
The closure of the User's and/or Member's Personal Account does not prevent the latter from accessing the Site's content accessible to the Visitor.
ARTICLE 9: Visitor's Obligations
The Visitor undertakes to use the Site only under the conditions defined by these TOS and thus:
not to divert the use of content for personal or advertising purposes;
not to fraudulently access and/or remain on the Site, understood as an automated data processing system. Any fraudulent access or maintenance on the Site is prohibited and criminally punishable. The same applies to any hindrance or alteration of the Site's operation, or in case of introduction, deletion or modification of the data contained therein;
not to disrupt the proper functioning of the Site, and in particular by introducing viruses.
Content published on the Site by the User and/or Member must not, in particular:
be contrary to public order and good morals,
be offensive, defamatory, racist, xenophobic, revisionist, pedophile, pornographic, homophobic, or infringe on the honor or reputation of others, incite discrimination, hatred of a person or a group of people because of their origin, their belonging or non-belonging to a specific ethnic group, nation, race or religion, threaten a person or a group of people;
incite suicide, incite to commit a crime, an offense, an act of terrorism or condone war crimes or crimes against humanity.
ARTICLE 10: Responsibility of the User and the Member
The User and the Member use the Site's Services under their exclusive responsibility.
The User and the Member undertake to use the Site in compliance with these TOS, applicable laws and regulations.
The User and the Member are solely responsible for the content they publish on the Site and the consequences of its dissemination.
KomNmoK reserves the right to refuse any User Content published online, without having to justify it to the User and/or Member. User Content may also, at any time and for any reason, be deleted or modified by KomNmoK. The User receives no justification or prior notification before the deletion or modification of User Content. However, there is a quality charter that KomNmoK can provide upon request, particularly regarding the quality of images in the real estate, architecture, and design object categories.
ARTICLE 11: Guarantees
The Visitor guarantees to KomNmoK that they have the necessary rights, licenses, and authorizations for the content they publish on the Site.
The Visitor undertakes not to publish content over which third parties hold rights, unless they have the prior authorization of the third party concerned.
Consequently, the Visitor guarantees KomNmoK against any action, legal recourse, claim, demand, or opposition from any person invoking an intellectual property right or an act of unfair competition and/or parasitism and/or an infringement of privacy that would be directly or indirectly related to the publication of content by a Visitor.
ARTICLE 12: Rights granted by the Visitor to KomNmoK.
The Visitor retains their intellectual property rights over the content they publish on the Site.
However, when the Visitor publishes content on the Site, they grant KomNmoK the following rights:
the non-exclusive, transferable, free, and worldwide right to use, reproduce, distribute, and represent the User Content as part of the Services or in connection with the provision of the Site, for the promotion and redistribution of all or part of the Site (and resulting derivative works) in any format, on any medium, and via all media channels. This right is granted for the entire duration of copyright protection.
ARTICLE 13: KomNmoK's intellectual property rights
With the exception of User Content and Third-party Content accessible on the Site, all other content available on the Site such as trademarks, designs, models, images, texts, photos, logos, graphic charters, software and programs, databases, sounds, videos, domain names, design or any other element composing the Site are the exclusive property of KomNmoK. This content is protected by copyright, trademark law and all other intellectual property rights held by KomNmoK or its licensors.
These TOS do not imply any transfer of any kind to the Visitor of intellectual property rights over content belonging to KomNmoK.
Any reproduction and/or representation, total or partial, without the express prior authorization of KomNmoK, of content over which it holds intellectual property rights is prohibited and would constitute an infringement.
Consequently, the Visitor refrains from any action and any act likely to directly or indirectly infringe KomNmoK's intellectual property rights.
ARTICLE 14: Personal Data
The Visitor is informed that, during their navigation on the Site, personal data concerning them may be collected via comment and exchange areas, data collection forms they fill out, particularly in case of contact request, creation of a Personal Space, contact with an advertiser, etc.
KomNmoK is the data controller concerning the collection and processing of this data.

KomNmoK cannot guarantee the Visitor that: the use of the Site will be uninterrupted, secure, or error-free;
the information the Visitor accesses would be accurate or reliable.
ARTICLE 17: Security and Confidentiality
KomNmoK does not guarantee optimal security and confidentiality of transmitted data. However, KomNmoK undertakes to implement all necessary means to best ensure the security and confidentiality of data.
The Visitor is aware that data circulating on the internet is not necessarily protected, particularly against possible misappropriation.
The Visitor agrees to take all appropriate measures to protect their own content and data from contamination by possible intrusions, viruses, or malicious software on the internet network.
The Visitor declares to know and accept the characteristics and limits of the internet, the nature of the internet network, and in particular, response times for consulting, querying, or transferring data.
The Visitor undertakes to inform KomNmoK of any failure of the Site of which they become aware.
ARTICLE 18: Hypertext Links
The Site contains hypertext links providing access to third-party websites.
The sites that the user accesses via hypertext links do not belong to KomNmoK.
KomNmoK is not responsible for the content published on these third-party sites following the activation of the hypertext link, nor for the privacy policy of these sites. The Visitor cannot invoke KomNmoK's responsibility in case of loss or damage of any kind whatsoever due to the activation of hypertext links.
French law applies to these general conditions, regardless of the place of performance of the parties' obligations.
